Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") are a binding agreement between you and Meralte Labs ("we", "us", "our") governing your use of the Macro AI mobile application ("the App"). By downloading, installing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

2. Eligibility

You must be at least 17 years old (or the age of digital consent in your jurisdiction, if higher) to use the App. By using the App, you represent that you meet this requirement.

3. License to Use the App

Subject to these Terms, Meralte Labs grants you a personal, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, for your own personal, non-commercial use.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Reverse engineer, decompile, or attempt to derive source code from the App, except where expressly permitted by applicable law.
• Use the App to harass, abuse, or defame any person.
• Interfere with or disrupt the App or any servers or networks connected to it.
• Submit photographs of other people without their consent.
• Use the App in connection with the diagnosis, treatment, or management of any medical condition for yourself or others.

5. Wellness Use Only — Not Medical Advice

Macro AI is provided for general fitness, nutrition, and wellness purposes only. It is not a medical device, does not provide medical advice, and is not intended to diagnose, treat, cure, or prevent any disease. Nutrition estimates, macro targets, exercise suggestions, and recipe recommendations are educational and may be inaccurate. Always consult a qualified healthcare professional before changing your diet or exercise routine, especially if you are pregnant, nursing, under 18, elderly, have an eating disorder, or have any medical condition.

6. Your Content

You retain all rights to the content you create or upload in the App ("Your Content"), including photos, custom recipes, and notes. Your Content is stored in your account on our cloud infrastructure (Supabase) under row-level-security policies that prevent any other user from reading it, and is also sent to third-party services where you explicitly request it (for example, submitting a meal photo to OpenAI for AI analysis). You may delete Your Content at any time by removing individual entries inside the App or by deleting your account entirely (Profile → Settings → Delete account).

7. AI Features and Generated Content

The App includes features that send your input (such as a meal photo) to third-party AI providers (currently OpenAI) and return generated output (such as estimated nutritional values). AI output may be inaccurate, incomplete, or misleading. You are responsible for reviewing AI output before relying on it. We do not warrant the accuracy of any AI-generated content.

8. Subscriptions, Pricing, and Auto-Renewal

The App is free to download and includes both free and premium features. Premium features require an active subscription purchased through Apple's In-App Purchase system on iOS or Google Play Billing on Android. Current subscription options are:

• Monthly subscription: $7.99 USD / €6.99 EUR per month.
• Annual subscription: $24.99 USD / €22.99 EUR per year.

Prices may vary by country and currency, as set by Apple or Google in your local store. The actual price you pay is shown to you in the App and on the store's purchase confirmation screen before you complete the transaction.

Auto-renewal. Subscriptions automatically renew at the end of each billing period (monthly or annual) at the then-current price, charged to your Apple ID or Google Play account, unless you cancel at least 24 hours before the end of the current period.

9. Free Trials

If your subscription includes a free trial (currently 7 days), you will not be charged during the trial period. To avoid being charged, you must cancel at least 24 hours before the trial ends. If you do not cancel, you will automatically be charged the subscription price at the end of the trial. Each Apple ID or Google Play account is eligible for the free trial only once per subscription type, as determined by the platform.

10. Cancellation and Refunds

You can cancel an active subscription at any time:

• iOS: Settings → your name → Subscriptions → Macro AI → Cancel.
• Android: Google Play app → profile icon → Payments and subscriptions → Subscriptions → Macro AI → Cancel.

Cancellation takes effect at the end of the current billing period. You will retain access to premium features until then. We do not provide partial-period refunds for unused time, except where required by law.

Refund requests are handled directly by Apple (reportaproblem.apple.com) or Google (Google Play refunds) according to their respective policies. Meralte Labs cannot issue refunds on purchases processed by these platforms.

11. Price Changes

We may change subscription prices from time to time. Where required by law or platform rules, we will give you advance notice of a price change and an opportunity to cancel before the new price takes effect. Continued use of the subscription after a price change constitutes acceptance of the new price.

12. Third-Party Services

The App relies on services from third parties including OpenAI, Spoonacular, Open Food Facts, Supabase, RevenueCat, Apple, and Google. Your use of those services is also subject to their respective terms and privacy policies. We are not responsible for the acts or omissions of any third party.

13. Apple App Store Additional Terms

If you obtained the App from the Apple App Store, the following terms additionally apply:

• These Terms are between you and Meralte Labs only, and not with Apple. Meralte Labs (not Apple) is solely responsible for the App.
• Apple has no obligation to provide maintenance or support for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

14. Google Play Additional Terms

If you obtained the App from Google Play, your use is also governed by the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the App.

15. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate your access to the App or any premium features if you violate these Terms or if continued provision is no longer commercially viable. Provisions that by their nature should survive termination (including IP, disclaimers, limitations of liability, and governing law) will survive.

16. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. NUTRITIONAL AND FITNESS INFORMATION PROVIDED BY THE APP MAY BE INACCURATE.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL MERALTE LABS, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) US $50.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages; in those jurisdictions, the exclusions and limitations above apply only to the maximum extent permitted by law.

18. Indemnification

You agree to indemnify and hold harmless Meralte Labs from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of your misuse of the App, your violation of these Terms, or your violation of any third-party right.

19. Governing Law

These Terms are governed by the laws of the jurisdiction in which Meralte Labs is established, without regard to its conflict-of-laws rules. Mandatory consumer protections of your country of residence still apply. Disputes will be resolved in the competent courts of that jurisdiction, except where mandatory law gives consumers the right to sue locally.

20. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced in-App or by updating the "Last updated" date above. Continued use of the App after an update constitutes acceptance of the revised Terms.
